regarding your order with us.

TRANSACTIONS

If you wish to purchase any product or service made available through this web site (“Site”) (each such

purchase, a “Transaction”), you may be asked to supply certain information relevant to your Transaction

including, without limitation, your billing address, and your shipping information. By submitting such

information, you grant to GIAVA the right to provide such information to third parties for purposes of

facilitating the completion of Transactions initiated by you or on your behalf. Verification of information

may be required prior to the acknowledgment or completion of any Transaction.

All descriptions, images, references, features, content, specifications, products, and prices of products and

services described or depicted on the Site are subject to change at any time without notice. Certain

weights, measures, and other descriptions are approximate and are provided for convenience purposes

only. The inclusion of any products or services on the Site does not imply or warrant that these products or

services will be available. GIAVA reserves the right, with or without prior notice, to do any one or more of

the following: (i) limit the available quantity of or discontinue any product or service; (ii) impose conditions

on the honoring of any coupon, coupon code, promotional code, or other similar promotion; (iii) bar any

user from making or completing any or all Transaction(s); and (iv) refuse to provide any user with any

product or service. You agree to pay all charges that may be incurred by you or on your behalf through the

Site, at the price(s) in effect when such charges are incurred including, without limitation, all shipping and

handling charges. In addition, you remain responsible for any taxes that may be applicable to your

Transactions.

AVAILABILITY, PRICING, ERRORS, AND INACCURACIES

GIAVA’s acknowledgement of an order means that your order request has been received; it does not mean

that your order has been accepted or shipped or that the price or availability of an item has been

confirmed. GIAVA makes a conscientious effort to describe and display its products and services accurately

on the Site. Despite these efforts, a small number of items on the Site may be mispriced, described

inaccurately, or unavailable, and we may experience delays in updating information on the Site and in our

advertising on other sites. As a result, we cannot and do not guarantee the accuracy or completeness of

any information, including prices, product images, specifications, availability, and services. GIAVA reserves

the right to change or update information and to correct errors, inaccuracies, or omissions at any time

without prior notice. We apologize for any inconvenience. As part of our shipping procedures, we verify

the availability and the price before an item is shipped. If an item’s correct price is lower than our stated

price, we will charge the lower amount and ship you the item. If an item’s correct price is higher than our

stated price, if the item is no longer available, or if we determine that there were inaccuracies in our

product information, we will cancel your order and notify you of such cancellation via email.

SHIPPING

Orders will be shipped using our preferred provider. We are unable to accommodate shipping orders on a

customer’s personal shipping account.

FREE SHIPPING TERMS

Free shipping is available on orders over $50 on consumable items (coffee) to any address in the

contiguous United States. Free shipping does not apply to orders shipping to Alaska, Hawaii, APO/military

addresses or on any international orders. We will use the lowest cost means for free shipping. You may

select from faster shipping methods during checkout. Orders placed with free shipping are processed

between 24 – 48 hours after order placement.

RETURNS – CONSUMABLE ITEMS (COFFEE)

Due to quality control and food safety issues, we are unable to accept returns on coffee. Even if these

items are still sealed, we cannot assume they are tamper-free once they leave our premises. Contact our

Customer Support team at (914) 712-8950 within 3 days of receiving your order, and we will do our best to

resolve any issue or errors with your order.

RETURNS – NON CONSUMABLE ITEMS

All Returns or Exchanges on merchandise (non-coffee) must be requested within 14 days of the purchase

date. Email your order number, name, reason for a Return/Exchange, and the item and quantity you wish

to Return/Exchange to orders@giavacoffee.com. We will contact you with information on how your return

will be processed. Shipping and handling fees will not be reimbursed; if you selected Free Shipping during

checkout, we will deduct our original shipping and handling fees from your overall refund. GIAVA reserves

the right to charge a 15% restocking fee.

DISCLAIMER OF WARRANTY

GIAVA does not manufacture the non-consumable items, equipment and merchandise sold to customer.

GIAVA, has not made and does not make any representation or warranty of any, express or implied, with

respect to the non-consumable items, equipment and merchandise, its suitability or fitness for any

purpose or merchantability. Customer accepts the non-consumable items, equipment and merchandise

“AS IS.” To the full extent permitted by law, GIAVA will incur no liability whatsoever to customer arising out

of or in connection with any defect in or condition of the non-consumable items, equipment and

merchandise or its use, operation or function.
